96-year-old Amanda Rice Stevenson is in jail without bond after being charged with the murder of her 53-year-old nephew. John Rice was found in the suspect’s bedroom.

Amanda Rice Stevenson was arrested Sunday night and is believed to be the oldest person charged with murder.

It is not known whether Stevenson shot Rice, however investigators say Stevenson used a .357 caliber gun to kill her nephew.

Charges against Rice Stevenson were eventually dropped as she was declared mentally incompetent to stand trial.

“The defendant is a 98-year-old
woman whose competency became an issue during the early stages of the prosecution,” the state’s form reads. “Dr. Jack Merwin and Dr. Roger Davis evaluated her for her competency and they both determined that she was incompetent to proceed.

Furthermore, both of the doctors determined that the defendant’s competency was non-restorable.
