A Fatal Traffic Stop
Tyre Nichols, a 29-year-old Black man, was pulled over on January 7, 2023, for alleged reckless driving. After fleeing on foot, Nichols was caught and brutally beaten by officers.
The violent encounter was captured on surveillance and bodycam footage.
Nichols died three days later from his injuries. The video, released weeks later, sparked widespread outrage, showing officers delivering repeated blows while issuing conflicting commands.

In 2024, a federal jury convicted officers Tadarrius Bean, Demetrius Haley, and Justin Smith on felony charges related to Nichols’ death. However, Judge Lipman has now ordered new trials. Lipman is citing a controversial comment allegedly made by Judge Mark Norris, who presided over the original proceedings.
Court documents show that Norris reportedly said gang members had infiltrated the Memphis Police Department “to the top.” He made the remark shortly after a carjacker shot his law clerk, just five days after the jury returned its verdict. Although Norris later recused himself from sentencing, Lipman emphasized that even the appearance of bias can undermine public confidence in the judicial process.
“What is required is not only an absence of actual bias, but an absence of even the appearance of judicial bias,” Lipman wrote, referencing precedent that supports her decision.
Legal Implications and Next Steps
While Lipman did not find evidence of actual bias in the trial itself, she concluded that Norris’s alleged statements could cast doubt on the fairness of the proceedings. Federal prosecutors will retry Bean, Haley, and Smith in federal court. They had scheduled sentencing for December 2024 but postponed it after Norris recused himself in June.
Two other officers involved in the incident, Emmitt Martin and Desmond Mills, pleaded guilty to federal charges. Their sentencing remains pending.
