Florida homeowner jailed over HOA dispute over brown grass
Irena Green, a Hillsborough County, Fl. mother of two, was cited for brown grass, a dented garage door, mildew-covered mailbox and parking a cargo van in her driveway—issues she says stemmed from drought restrictions and a shaded lawn.

A homeowners association dispute over lawn care landed Irena Green in jail for seven days after her Creek View subdivision HOA pursued court action for property code violations.

Green, a Hillsborough County, Fl. mother of two, was cited for brown grass, a dented garage door, mildew-covered mailbox and parking a cargo van in her driveway—issues she says stemmed from drought restrictions and a shaded lawn.
The HOA filed a lawsuit when Green missed mediation. Representing herself in court, she submitted a handwritten defense that was dismissed. A judge then ordered her to fix the violations within 30 days or face jail time.
Though Green complied, she missed a later court date she says she was never properly notified of.
Arrest and Detention
On May 23, 2025, Green was pulled over by police and informed of an outstanding warrant. She was taken to jail and held without bond for contempt of court.
Legal and Public Response over HOA dispute
Legal experts say the case underscores the power HOAs wield and the importance of understanding homeowner obligations.
Green’s sister-in-law, a paralegal, filed an emergency petition that led to her release. A different judge reviewed the evidence and ordered her immediate release, despite opposition from the HOA’s attorney.
Broader Implications over HOA’s
The incident has reignited debate over HOA enforcement practices. Florida Governor Ron DeSantis recently signed House Bill 1203, limiting HOA authority and banning certain fines and restrictions deemed excessive.
“Seven days in the jailhouse like a criminal,” Green said to ABC ACTION NEWS . “It makes me feel horrible… to be treated like that for brown grass at my own home”.
