A Texas Court of Appeals upheld former Dallas police officer Amber Guyger’s 2019 murder conviction and sentence for killing Botham Jean in his own apartment in 2018.

She will continue serving her 10-year sentence at a prison in Gatesville, Texas.

She says incident was a mistake

During her appeal, Guyger argued that her mistaken belief that she was in her own apartment negated her culpability for murder.

Jean was in his apartment, eating ice cream on Sept. 6, 2018, when Guyger, who lived on the floor above him, walked into his apartment, thinking it was her own. Guyger, who was off duty but in uniform, said she believed Jean was an intruder and shot him.
