Preemptive Strike

When I was a young child I remember attending elementary school in Queens, NY, and being told that voting rights were important. I was told that hundreds of thousands, possibly millions, struggled, fought and died for others to have the right to vote. I was taught about a man named Martin Luther King Jr. and about his efforts, as well as others, to “win” voting rights for the Black and Brown people in this country. All history lessons that I believed in. Until the summer of 2013.

 

On Tuesday, June 25th, 2013, the Supreme Court ruled on Shelby County v. Holder. The ruling effectively “gutted” Section 4 (S4) a key provision of the Civil Rights Act of 1965, which struck down most of the old Jim Crow restrictions that prevented Black people from voting. The same Act that I was taught leveled the playing field for Black and Brown people in this country regarding voting rights was essentially thrown out.  In a 5-4 ruling, Chief Justice John Roberts wrote that “things have changed dramatically”, thus making the need for S4 obsolete. However, the reality is quite the opposite.

 

Since the striking down of S4 states like Texas, South Carolina and Florida have implemented voter laws that are disgustingly discriminatory and targets predominantly low-income Black and Brown people. S4 road-blocked these laws from being passed, however, since last year these states and others are moving aggressively to pass and implement these laws.

 

Additionally, people who have felony convictions may lose their voting rights while on probation or parole and in some states all-together. It is no coincidence that the same demographic that is negatively impacted by the striking down of S4, are also grossly over-impacted by the criminal punishment system (More about this in my next post).

 

Battleground

Denying access to voting rights is one of multiple battle fronts where Black and Brown voices are being targeted for silence. From a historical perspective the need to mis-educate, mislead, and misinform the Black and Brown masses has been an ongoing war that has been covert, and sometimes overt, yet the war continues.

 

How does that occur today you may ask? Through a continuous bombardment of our senses. Television (or should I say Tell-a-lie-vision) shows such as Bad Girls Club, The Real housewives of whatever county that they choose, Love and Hip-Hop, use of terms like Ratchet, thug, Ni*&a, etc. are all sources of media and culture that fuel a flawed perception that Black and Brown people hate, envy, talk about, and overall scheme on one another constantly. Thus, giving a general perception that these shows are a reflection of the average Black and Brown family.

 

Further, our money culture has become so warped (by design) that we place value on items that are completely above our financial means with the hope that these items will give us a sense of “eliteness” or “belonging” or “validation”. Clothing brands such as True Religion, Louis Vuitton, Louboutin a.k.a. red bottoms, to name a few, are all clothing brands that are coveted in our culture and neighborhoods, yet are all owned by the mega-rich, who ironically DO NOT design their clothing primarily for us. Yet, the association with having these things distracts us from the real issues that are eroding our culture.

 

Victory?…

Why attack voting rights? Simple. With the impending end of President Obama’s two-terms the presidential election of 2016 is set to be a battle for Republicans and Democrats, even more so for Republicans, as it is widely anticipated that Hilary Clinton will run and win the Democratic Nomination and go on to give any Republican candidate a run for their money. With lame attempts by McCain-Palin in 2008 and Romney-Ryan in 2012, the Republican Party is aiming to and achieving the degradation of the Black and Brown vote, thus creating odds that are in their favor as majority of us vote Democrat. Also, losing the right to vote essentially makes a person a second-class citizen, who is basically forced to sit back and watch the political process. While some may say that an individual vote does not count, the right to vote should be freely given and maintained without threat of coercion and systemic discrimination that stems from a voter ID law or a felony conviction.

 

However, the dark tone of this post comes with a silver-lining. The masses are organizing against the GOP’s plans. Movements such as Moral Mondays, Occupy Wall Street, election of politicians that are outside of the two primary parties are all signs that the general public are awakening and spreading the word about the actions of the GOP. In part two of this three part series I will be discussing the criminal punishment system and its effects on the Black and Brown communities; the vicarious trauma that comes from incarceration; and how the prison industrial complex chews up and spits out our young men and women at alarming rates. Honor student killed by stray bullet while visiting Delaware State University

A shooting at Delaware State University has claimed the life of 18-year-old honor student Camay Mitchell De Silva.

Camay Mitchell De Silva, of Wilmington, Delaware, was shot and killed Sunday, on the Delaware State University campus.

The 18-year-old was visiting her best friend, a Delaware State student, when the tragic shooting occurred.

She was an honor student

De Silva was a 2023 graduate of Concord High School who graduated with a 3.0. She spent her first semester of college at Morgan State University in Baltimore but decided she wanted to come home to Delaware.

She then attended Delaware Technical Community College and planned to attend DSU in the fall to pursue a degree in Computer Science, with the goal of working in cybersecurity.

De Silva often hung out on campus with her best friend to get comfortable before attending DSU.

The family said De Silva was visiting that friend at DSU on Saturday, April 20, and attended a party on campus that night. Around 1:40 a.m. on April 21, DSU Police received a report of shots fired on campus. The responding officers found De Silva in a residence hall suffering from a gunshot wound to her upper body. The officers administered aid and then took her to a nearby hospital where she later succumbed to her injuries.

Police say De Silva was not the intended target. Dover Police Department Chief Thomas Johnson Jr. told NBC10 there was a dispute that she was not involved in and she was hit by a stray bullet.

The suspects were seen fleeing the area and no arrests have been made, said authorities.

Dover Police released a statement from De Silva’s family requesting time to grieve and to plan for her celebration of life.

They also said they pray for and support the DSU community, law enforcement and the local community as they are “forced to manage this tragedy.”

Dover Police are still pursuing leads in the fatal shooting of Camay Mitchell De Silva.

Exonerated man on a mission to rebuild his life

C.J. Rice, a man who served more than 12 years behind bars for an attempted murder he was falsely convicted of, was officially exonerated on March 18, 2024. He is now on a mission to rebuild his life.

Charles “CJ” Rice was just 17 years old when he was convicted of a crime he did not commit.

Now 30 year old Rice is using the injustice of the last 13 years to galvanize the life he almost spent behind bars after being exonerated and declared legally innocent of the crime he was convicted of in 2013 on March 18, 2024.

According to the GoFundMe, CJ wants to “embrace this opportunity” and become a paralegal.

With the help of Dream.org, the GoFundMe aims to help CJ start a new life with everything from a place to stay to clothes to wear as he builds a new future.

The CJ Rice case

CJ Rice, formally known Charles J. Rice, was convicted in a September 2011 shooting for attempted murder and sentenced to 30-60 years behind bars in 2013.

According to the Pennsylvania Innocence Project, the South Philadelphia shooting left a woman identified as Latrice Johnson, a 6-year-old girl and two others injured.

Johnson called 911 after the shooting and described the suspects as two men running away in hoodies and black sweatpants but couldn’t fully identify them.

Through an initial investigation with victims in the hospital, Rice’s co-defendant, Tyler Linder, was identified as one of the shooters. Detectives interviewed Johnson while she was in the hospital and she identified 17-year-old Rice as one of the shooters running away although she hadn’t seen the teen in a few years. Rice had been friends with Johnson’s son when he was younger, according to the Pennsylvania Innocence Project.

In her description, Johnson said Rice was wearing a hoodie and claimed that she was able to see his full face and long braids poking out the side of the hood. However, Rice’s arrest photo depicted him with shorter cornrows flushed against his head. Despite this, a case against Rice and Linder was built.

According to the Pennsylvania Innocence Project, among the evidence was a theory that the shooting was retaliatory, which wasn’t proven. That’s because Rice was shot and injured a few days prior. It’s alleged the suspects ran from the scene, and Rice’s counsel never used his medical records as evidence to help Rice’s case.

Rice’s case received national attention after CNN anchor Jake Tapper began reporting on it. His father, Dr. Theodore Tapper, is Rice’s former doctor and treated his injuries.

Although it was alleged that the shooters ran from the 2011 crime scene, this is something that Dr. Tapper believed Rice just physically couldn’t do at the time.

Officials believed the 2011 shooting involved gang affiliations, leading the DA’s Gun Violence Task Force to begin their investigation to see whether or not Rice could be re-tried for the shooting or to dismiss the charges in full.

This suggestion of motive and the sole faulty eyewitness identification of CJ led to his conviction on four counts for attempted murder.

A free man

Rice’s defense counsel filed a habeas petition to get CJ out of prison and have his conviction overturned.

On March 18, 2024, the Philadelphia County Court of Common Pleas granted the Commonwealth’s motion to dismiss all charges against Rice, officially making CJ a free man.

Driver intentionally mowed down couple, killing wife, after calling 911 with ‘threats to shoot a school’

Shaunda Bizzell was killed by a man who drove his car into her and her husband minutes after he called 911 and made threats to bomb a building, police say.

Derek and Shaunda Bizzell were taking an evening stroll in their Chesterfield, Virginia neighborhood Monday night when a crazed man plowed into them.

“We walked around the curb. We could see a car coming up the middle of the street like cars always do, and then he got closer to us,” Derek Bizzell told WWBT. “I could see him veer. I screamed her name, and all I heard was the thump.”

The husband wound up under the car, while his wife landed on top. When he grabbed his phone to call 911, he was too shocked to be able to speak, but good samaritans who rushed over to help called in the deadly emergency.

Before hitting the couple, police say the man called 911 with “threats to shoot a school, bomb a building and assault police officers.”

Suspect

The driver, identified as Daniel Anderson, 22, purportedly has a history of mental health issues, according to his father. He “intentionally steered” his 2012 Hyundai toward the innocent couple, police said.

Shaunda Bizzell, 42, a married mom of two adult children, was taken to a nearby hospital but died from her injuries. Her husband was also hurt in the collision but has since been released from the hospital.

“I’m a little banged up, but if I could trade places with my wife, I would,” the heartbroken man said.

It was Shaunda’s first time she’d joined her husband Derek on his regular evening stroll around their neighborhood in Chesterfield, according to WWBT.

Bizzell said he has not been sleeping or eating, and feeling “just numbness” since losing his beloved wife.

He added that while he has not forgiven the driver, “I do pray for his family because I’m pretty sure they are hurting the same way we are hurting right now,” he said.

Anderson has been charged with murder, malicious wounding, making threats of death or bodily injury and making threats to bomb or damage buildings.

He is being held without bond.
